Virtual Family Law/Divorce Mediation FAQ
1) The other party and I do not agree on everything, so we cannot mediate our case, right?
Disagreement is expected. "Mediation" can be defined as "assisted negotiations." One of the main responsibilities of a mediator is to facilitate agreements between you and the other party.
2) The other party and I basically agree on everything, so a family law mediator is not helpful, right?
A family law attorney mediator will likely benefit your case in at least the two following ways: (i) You want to make sure documentation is drafted, filed and served correctly, and the family law attorney mediator handles these tasks. (ii) You want to ensure that your matter is handled correctly the first time, that the orders you choose are what you both intend and that the orders are enforceable. A family law attorney mediator has the knowledge and experience to do this. Most of the time, people either do not discuss certain helpful terms or the terms they reached turned out to either be unenforceable or carried unintended adverse repercussions.

5) What family law issues can be mediated?

6) Since Mr. Ginter is a family law/divorce lawyer, does he "represent" me as a mediator?
When Mr. Ginter is hired as a mediator, he is not sitting as an attorney. He does not become your or the other party's "attorney of record." Instead, as a family law mediator, Mr. Ginter is a neutral participant who is there to help both you and the othter party through your case.
7) The other party is outspoken, while I am more quiet. Will I be able to have a voice in mediation?
Yes. Mr. Ginter provides a safe atmosphere for everyone to be heard in mediation. And, since family law mediation is a completely voluntary process, you are the one that chooses whether to agree on the various items in your case.
