Benefits of Family Law/Divorce Mediation
Lower Cost
Mediation is typically less expensive than litigation. Court apprearances, and trials are expensive. In mediation, there is no trial and typically no court appearances. Additionally, instead of each person paying for his/her own attorney, you can choose to hire only one professional...the mediator. Litigation cases easily extend beyone a year, while most mediation cases resolve in less than a year.
Control
In litigation, a judge determines the out come of your case when your case is brought into court and, much of the time, no one is happy with a judge's ruling. In mediation, you and the other party choose your outcome. If you are choosing your own outcome, you are both satisfied with the results because all outcomes are agreed upon.
Privacy
In litigation, court appearances are typically open to the public in family law where sensitive issues can be heard by anyone in attendance. Conversely, in mediation, all discussions are confidential and done in a private setting out of court. Whether or not you are a high profile person, such as an actor, mediation offers a private and confidential setting to discuss your case.

Family Law/Divorce Mediation FAQ
1) The other party and I do not agree on everything, so we cannot mediate our case, right?
Disagreement is expected. "Mediation" can be defined as "assisted negotiations." One of the main responsibilities of a mediator is to facilitate agreements between you and the other party.
2) The other party and I basically agree on everything, so a family law mediator is not helpful, right?
A family law attorney mediator will likely benefit your case in at least the two following ways: (i) You want to make sure documentation is drafted, filed and served correctly, and the family law attorney mediator handles these tasks. (ii) You want to ensure that your matter is handled correctly the first time, that the orders you choose are what you both intend and that the orders are enforceable. A family law attorney mediator has the knowledge and experience to do this. Most of the time, people either do not discuss certain helpful terms or the terms they reached turned out to either be unenforceable or carried unintended adverse repercussions.
3) Why should we choose a family law attorney as our mediator?
First, the mediator drafts documents for both you and the other party. A family law attorney has experience with correctly drafting the necessary legal documents. Second, a family law attorney mediator can provide you with opinions on how the law would apply to issues in your case to help you make informed decisions.
4) Why should we choose family law attorney, Bryan Ginter, as our mediator?
Mr. Ginter has practiced family law since 2006. Mr. Ginter has been a trained and practicing mediator since 2008, and he has extensive knowledge and experience as a family law attorney mediator. As a passion of his, Mr. Ginter has devoted significant time to the field of mediation: (i) He is a past board memember for a Sacramento mediation group, (ii) he was a guest lecturer at Sacramento State University on the topic of mediation, and (iii) he is a published author of the book, "Preparing for a Family Law Case: Money-Saving Tips and Options for Divorce and More," where he discusses family law mediation.
5) What family law issues can be mediated?
Most family law issues can be mediated, including the following: Divorce, legal separation, child custody, parenting time, child support, spousal support and property division..
6) Since Mr. Ginter is a family law/divorce lawyer, does he "represent" me as a mediator?
When Mr. Ginter is hired as a mediator, he is not sitting as an attorney. He does not become your or the other party's "attorney of record." Instead, as a family law mediator, Mr. Ginter is a neutral participant who is there to help both you and the othter party through your case.
7) The other party is outspoken, while I am more quiet. Will I be able to have a voice in mediation?
Yes. Mr. Ginter provides a safe atmosphere for everyone to be heard in mediation. And, since family law mediation is a completely voluntary process, you are the one that chooses whether to agree on the various items in your case.
