Ginter Family Law & Mediation
Ginter Family Law began in 2009 by family law attorney & mediator, Bryan Ginter. Family law services include mediation, collaborative law, document review, consultations and litigation support. We assist with a multitude of family law issues, including divorce, legal separation, premarital agreement drafting and review, child custody, child & spousal support, and more. We also offer basic estate planning: Will, Durable Power of Attorney, Advance Health Care Directive and Living Trust.
Family Law From A Constitutional Perspective
"When in the Course of human events, it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the opinions of mankind requires that they should declare the causes which impel them to the separation.We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, --That whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their Safety and Happiness. Prudence, indeed, will dictate that Governments long established should not be changed for light and transient causes; and accordingly all experience hath shewn, that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same Object evinces a design to reduce them under absolute Despotism, it is their right, it is their duty, to throw off such Government, and to provide new Guards for their future security." Declaration of Independence, July 4, 1776.
"The voluntary consent of the human subject is absolutely essential. This means that the person involved should have legal capacity to give consent; should be so situated as to be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision." The Nuremberg Code (1947).
The United States Supreme Court said that the right of parents to be and active and integral part of their children’s lives as “perhaps the oldest of the fundamental liberty interests recognized by [the Supreme] Court.” Troxel v. Granville, 530 U.S. 57 (U.S. 2000).
Parents - not governent - have the fundamental right to parent their children, which includes medical treatment. Our freedoms have been given to us by our Creator, not by government. As such, government cannot remove these freedoms. Government receives its limited power by The People to secure our unalienable rights. Unfortunately, government - on all levels - has exceeded its constitutional powers, including unlawful restrictions of freedoms and medical mandates. As the Declaration of Independence states, We The People not only have the right, but the duty, to hold our elected officials accountable and to change or abolish such governmental tyranny. You must stand strong and bravely assert your fundamental right to parent your children.
